In all cases in which the contract includes an arbitration agreement or other agreement between the parties which cites in any manner the Arbitration Rules or makes reference to the Milan Chamber of Arbitration or Genoa Chamber of Arbitration or simply to the Italian National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather, a request for arbitration may be submitted using the following procedure.

FILING THE REQUEST FOR ARBITRATION

The request for arbitration must be filed with National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather, in Via Brisa 3, 20123 Milano.

The request may be filed:

CONTENT OF THE REQUEST FOR ARBITRATION

The request for arbitration is to be signed by the party or by the party’s counsel, and shall contain, or be accompanied by:

  • the name and domicile of each party;
  • a description of the dispute;
  • indication of the relief sought and the relative economic value;
  • the appointment of the arbitrator or useful information concerning the number of arbitrators and the manner in which they are to be chosen;
  • indication, if any, of the evidence requested in support of the claim and any documentation that the party deems it useful to produce;
  • indications, if any, of the law and regulations applicable to the merits of the dispute, or to a decision to be based on the principle of equity, of the venue and the language in which arbitration is to be held;
  • the power of attorney granted to counsel, if counsel has been appointed;
  • the arbitration agreement/clause.

The request for arbitration must be filed in an original copy for National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather, an original copy for each party and in as many original copies as there are arbitrators. The documents produced must be filed in an original copy for National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather, an original copy for each party and in as many original copies as there are arbitrators.

No charge is made at the time of filing the request for arbitration.

Stamp duty is applicable, and Euro 16.00 stamps  (marche da bollo) must be affixed to the original copies of the request for arbitration (one marca da bollo every four pages of each original copy and a further marca procura  stamp on the original for National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather; the power of attorney for the Notary Public does not require stamps), in compliance with Presidential Decree no. DPR 642/1972.

TRANSMISSION OF THE REQUEST FOR ARBITRATION

The request for arbitration must be transmitted by National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather to the respondent within five working days of the date of filing, by any means suitable to ensure it is received.

The claimant may also transmit the request for arbitration directly to the respondent, provided that the request for arbitration has been filed with National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather, which will in any event transmit the request to the respondent, thus ensuring compliance with any time limits established by the rules.

WHAT HAPPENS IF THERE IS NO ARBITRATION CLAUSE OR IF THE ARBITRATION CLAUSE DOES NOT REFER TO THE NATIONAL AND INTERNATIONAL CHAMBER OF ARBITRATION FOR THE TRADING OF HIDES, SKINS AND LEATHER OR TO THE ARBITRATION RULES.

If the contract does not include an arbitration clause or if the arbitration clause included does not refer to the National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather or to the Arbitration Rules, the party may file an arbitration proposal pursuant to Art. 1.3 of the Rules. Such proposal must be accepted by the other party, by personally signed written declaration within the time limit indicated to the party by National and International Chamber of Arbitration for the Trading of Hides, Skins and Leather.
