ARBITRATION COSTS
The costs of arbitration proceedings are made up of the following items:
- Arbitration Chamber fees
- Arbitrational Tribunal fees
- Fees of technical consultants appointed by the arbitration body *
- Reimbursement of expenses of the Arbitration Chamber, arbitrators and technical consultants appointed by the arbitration body
ARBITRATION CHAMBER FEES
The fees charged by the Arbitration Chamber for administering the proceedings are determined with regard to the value of the dispute **, in accordance with the Schedule of Fees annexed to the Rules. Activities included in, and activities excluded from, the Arbitration Chamber fees are indicated in the Annex to the Rules.
ARBITRATION TRIBUNAL FEES
The fees charged by the Arbitration Tribunal (either single arbitrator or panel of three arbitrators) are determined with regard to the value of the dispute, in accordance with the Schedule of Fees annexed to the Rules.
The rates indicated in the annex are net of VAT and of other charges pursuant to the law, if any, and are shared between the parties.
FEES OF TECHNICAL CONSULTANTS APPOINTED BY THE ARBITRATION BODY
The fees of technical consultants appointed by the arbitration body are determined in accordance with the principle of fairness, also taking professional fees, judicial charges and any other circumstance into consideration.
REIMBURSEMENT OF EXPENSES OF ARBITRATORS AND TECHNICAL CONSULTANTS APPOINTED BY THE ARBITRATION BODY
Reimbursement of expensed incurred by arbitrators and technical consultants appointed by the arbitration body are required to be proved by means of relative receipts. If such receipts are not submitted, the expenses shall be deemed included in the relative fees.
*The Arbitration Tribunal may appoint, upon petition by the parties or on its own initiative, one or more arbitration appointed technical consultants, or delegate their appointment to the Arbitration Chamber. If they are appointed as technical consultants of the Arbitration Body, the parties shall be entitled to appoint their own technical consultants.
**The value of the dispute, for the purposes of defining the costs of the proceedings, is determined by the sum of the requests submitted by all parties; it is determined by the Secretary General on the basis of the parties’ introductory briefs and on the basis of the further indications of the parties and of the Arbitration Tribunal. If the value of the dispute is not determined or is indeterminable, the Appointments Commission shall establish it on the grounds of fairness.
ADVANCE AND FINAL DEPOSITS
The General Secretary shall request the parties to establish an initial fund after the exchange of introductory briefs, establishing a term for depositing the relative funds. The balance of the costs of the proceedings shall be requested by the Secretary General following the final award decided by the Appointments Commission and prior to the filing of the award. If a party fails to deposit the amount requested, the Secretary General may request it of the other party, establishing a term for payment of the same.
